Acceptable Use Policy

This Acceptable Use Policy (“AUP”) describes the policies of Vyper Hosting (“we”, “us”, or “our”), on the use, management and access that you are granted with when purchasing a product on our website (https://billing.vyperhosting.com). (the “Service”). By accessing or using the Service, you acknowledge that you and users that have gained access to Services through Customer accounts (“Users”) are responsible for the compliance with this Policy and agree to bound to it. If you do not consent to the same, please do not access or use the Service. We may modify this Acceptable Use Policy at any time without any prior notice, therefore it is your responsibility to periodically review this Acceptable Use Policy to stay informed of updates. You will be subject to and will be deemed to have been made, aware of and to have accepted, the changes in any revised Acceptable Use Policy by your continued use of the Service after the date such revised Acceptable Use Policy are posted.

Prohibited Uses

Illegal Activity: You are only permitted to access and utilise our services for legitimate needs. You are in charge of any access, storage, or distribution made via our Services by you or your Users. We forbid using the Services to distribute or store any information that would be against the law or other regulations. The use, storage, or transmission of any material that poses an illegal threat, is defamatory, or is otherwise illegal is prohibited, as is the use, storage, or transmission of any data that is protected by copyright, trademark, trade secret, patent, or other intellectual property rights without the necessary authorisation. The following are a few instances of illegal content:

  • Violating any proprietary or intellectual property rights, including but not limited to content covered by a copyright, trademark, patent, trade secret, or other intellectual property right. Software, images, and movies that are copied, distributed, or stored without permission may be considered infringement.
  • Anything that violates the law, violates someone's privacy or publicity rights, is abusive, threatening, defamatory, hurtful, or objectionable in any other way.

Complaints

We keep the right to revoke or suspend service access. We are not obligated to ascertain the veracity of complaints we receive from Internet users, internet organisations, or other parties before taking action in accordance with this AUP. We are under no duty to notify the User or Customer of the complaint or to identify the parties who have filed it.

Suspension or termination of services

We reserve the right to suspend and/or terminate the Services or the User's access to the Services if Customers or Users engage in conduct or a pattern of conduct while using the Services that violates the AUP or is otherwise illegal or improper. This includes, but is not limited to, repeated violations by a User whereby correction of individual violations does not, in our sole discretion, correct a pattern of the same or similar violations. We reserve the right to suspend or terminate the Services or the User's access to the Services without notice in cases where the operation Vyper Hosting is threatened or involves illegal activities, fraud suspected in connection with the use of the Services, harassment, or copyright infringement. We will make every effort to notify the Customer or User of any activity in violation of the AUP and request that the User ceases in such activity. We do not guarantee that we will keep an eye on or police activities taking place on the Services, and we have no duty to do so. We also pledge not to be liable to anybody, including customers and users, for any AUP violations.

Investigation and enforcement

We reserve the right to use active investigation, legal action, and prosecution to enforce this AUP. Although we reserve the right, we shall not be required to monitor or exert editorial control over any content that is stored, copied, or distributed via the Services. If the AUP is broken, we reserve the right to take appropriate action against the user or the customer.

Cooperation with law enforcement

For any legitimate purpose, including but not limited to following the law, defending our rights or property, or shielding Users from fraudulent, abusive, or illegal use of such services, we may also access and disclose any information (including transactional information) pertaining to a Customer's or User's access and use of our services.

Filters

We reserve the right to install and utilise any software, including programs intended to filter or stop access to the Services, in order to find and report violations of this AUP. The User agrees to allow us to gather information in order to assist in enforcing the AUP by accepting and using the Services and permitting Users to use the Services.
